1. Scope and Contracting Parties


1.1 Contracting Parties

These General Terms and Conditions (hereinafter "GTC") govern the legal relationships between:

- Swisslamic Help Organization (hereinafter "Organization", "we" or "us"), a humanitarian aid organization based in Switzerland

- Donors, sponsors, users of the website and other interested parties (hereinafter "Donors", "you" or "Users")


1.2 Scope

These GTC apply to:

- All donations (one-time or recurring) for projects and campaigns

- Sponsorships for children in need

- Use of the website https://swisslamic-v3.vercel.app and all associated services

- Newsletter subscriptions

- Contact via the website

- All other business relationships between the organization and donors


1.3 Applicable Law

These GTC are subject to Swiss law. For international donors, the provisions of Swiss law apply, unless mandatory provisions of the law of the donor's country of residence provide otherwise.


1.4 Jurisdiction

The place of jurisdiction for all disputes arising from or in connection with these GTC is the registered office of the organization in Switzerland, unless mandatory legal provisions provide otherwise.


2. Services of the Organization


2.1 Purpose of the Organization

The Swisslamic Help Organization is a humanitarian aid organization based in Switzerland dedicated to supporting people in need worldwide. The organization conducts humanitarian projects and campaigns, facilitates sponsorships, and provides emergency aid.


2.2 Services Offered

The organization offers the following services:


2.2.1 Projects and Campaigns

- Long-term aid projects in various areas (education, health, nutrition, water, emergency aid, etc.)

- Time-limited donation campaigns for specific purposes

- Projects and campaigns may include various locations worldwide


2.2.2 Special Types of Donations

- Qurban Donations: Various types of Qurban donations (Eid-al-Adha, Aqiqah, Hady, Kaffara, Nadhr, Voluntary, Community)

- Zakat Donations: Zakat donations with integrated Zakat calculator

- Emergency Donations: Donations for acute emergency situations


2.2.3 Sponsorships

- Facilitation of sponsorships for children in need

- Regular communication about the progress of sponsored children

- Possibility to send personal messages to the sponsored child


2.2.4 Information Services

- Newsletter with information about projects and activities

- Regular reports on the use of donations

- Transparency reports and annual reports


2.3 Availability of Services

The organization reserves the right to change, expand, or discontinue projects, campaigns, and other services at any time. The organization is not obligated to permanently offer all projects or campaigns displayed on the website.


3. Donations


3.1 Types of Donations

The organization accepts the following types of donations:


3.1.1 Monetary Donations

- One-time Donations: One-time financial contributions for projects or campaigns

- Regular Donations: Recurring donations (monthly, quarterly, annually)

- Designated Donations: Donations for a specific purpose or specific project

- Non-designated Donations: Donations without specific purpose designation


3.1.2 Special Types of Donations

- Qurban Donations: Donations for ritual slaughter (various types available)

- Zakat Donations: Donations to fulfill Zakat obligations

- Donations for Beneficiaries: Donations in the name of or for specific persons (living or deceased)


3.1.3 In-Kind Donations

- Material goods that can be used for aid projects

- In-kind donations are accepted after prior consultation with the organization


3.2 Donation Amounts


3.2.1 Minimum Amounts

For online donations, the following minimum amounts apply:

- Minimum donation amount: 5 CHF (or equivalent amount in other currency)

- For Qurban donations, the prices stated on the website per animal type and location apply


3.2.2 Currency

- The standard currency is Swiss Francs (CHF)

- Donations can also be made in other currencies, with conversion at the current exchange rate

- The organization assumes no responsibility for exchange rate fluctuations


3.3 Donation Process


3.3.1 Donation Form

- Donations are made through the donation form available on the website

- The donor commits to providing all required information truthfully and completely

- The organization reserves the right to reject donations with incomplete or incorrect information


3.3.2 Required Information

Depending on the type of donation, the following information may be required:

- Salutation, first and last name

- Email address

- Phone number (for certain projects/campaigns)

- Address (street, city, postal code, country)

- Donation amount

- Payment method

- Purpose designation (if desired)

- Beneficiaries (if applicable)

- Comments or messages


3.3.3 Confirmation

- After successful submission of the donation form, the donor receives a confirmation by email

- The confirmation contains a unique donation ID (UUID)

- The confirmation does not yet constitute acceptance of the donation


3.3.4 Acceptance of Donation

- The organization reserves the right to reject donations that:

- Are incompatible with the ethical principles of the organization

- Contain conditions that violate the interests of the organization or its target groups

- Originate from non-transparent or illegal sources

- Violate legal provisions

- Acceptance occurs through successful payment processing or by written confirmation from the organization


3.4 Purpose Designation of Donations


3.4.1 Designated Donations

- Designated donations are used exclusively for the purpose specified by the donor

- If the specified purpose cannot be fulfilled or cannot be fully fulfilled, the donor will be informed

- The organization may suggest using the donation for a similar purpose or refunding the donation


3.4.2 Non-designated Donations

- Non-designated donations are used as needed in ongoing projects

- The organization decides independently on the use of non-designated donations


3.4.3 Excess Funds

- If the donation amount for a project or campaign exceeds the required amount, excess funds will be used for similar projects or purposes

- The donor will be informed about the use of excess funds


4. Payment Terms


4.1 Payment Methods

The organization accepts the following payment methods:


4.1.1 Online Payments

- Credit card (Visa, Mastercard, American Express)

- Debit card

- Through the payment service provider RaiseNow AG (Switzerland)

- Payment processing is secure via encrypted connections


4.1.2 Bank Transfer

- Direct bank transfer to the organization's account

- Bank details will be provided by email after submitting the donation form

- The donor is obligated to specify the donation ID (UUID) in the payment reference


4.1.3 Cash Payment

- Cash payments are possible after prior consultation

- Cash payments must be received personally or by authorized representatives of the organization


4.1.4 Offline Payments

- Other payment methods by prior agreement


4.2 Payment Service Providers


4.2.1 RaiseNow AG

- Online payments are processed through RaiseNow AG (Switzerland)

- The organization assumes no liability for errors or failures of the payment service provider

- The General Terms and Conditions of RaiseNow AG apply additionally for online payments


4.2.2 Payment Failures

- In case of payment failures or failed payments, the donor will be informed

- The organization is not obligated to retry failed payments

- The donor is obligated to ensure successful payment


4.3 Payment Deadlines


4.3.1 Online Payments

- Online payments are processed immediately

- Payment must be made within 7 days after submitting the donation form


4.3.2 Bank Transfers

- Bank transfers must be received within 14 days after submitting the donation form

- In case of delayed payments, the organization reserves the right to reject the donation


4.4 Payment Fees

- The organization covers transaction fees for online payments

- Fees may apply for international bank transfers, which are borne by the donor

- The organization informs about applicable fees before payment


4.5 Currency Conversion

- For payments in currencies other than CHF, conversion is made at the current exchange rate

- The organization assumes no responsibility for exchange rate fluctuations

- The donor bears the risk of exchange rate changes


5. Sponsorships


5.1 Sponsorship Facilitation


5.1.1 Facilitation

- The organization facilitates sponsorships for children in need

- Sponsorships can be requested through the website

- The organization decides on the assignment of sponsorships


5.1.2 Sponsorship Request

- The following information is required for a sponsorship request:

- Name, email, phone, complete address of the sponsor

- Desired region (if available)

- Number of desired sponsorships

- Monthly amount

- Optional personal message to the child


5.1.3 Assignment

- The organization endeavors to facilitate sponsorships according to the sponsor's wishes

- A commitment for a specific sponsorship cannot be guaranteed

- The organization informs the sponsor about the assignment of a sponsorship


5.2 Sponsorship Contributions


5.2.1 Amount of Contributions

- The amount of monthly sponsorship contributions is determined by the organization

- Current contributions are stated on the website

- The organization reserves the right to adjust contributions (with advance notice)


5.2.2 Payment

- Sponsorship contributions are due monthly

- Payment is made by direct debit, bank transfer, or online payment

- The sponsor commits to paying contributions regularly


5.2.3 Payment Failures

- In case of payment failures, the sponsor will be informed

- After multiple payment failures, the sponsorship may be terminated

- The organization endeavors to maintain the sponsorship but cannot guarantee it


5.3 Rights and Obligations of the Sponsor


5.3.1 Rights

- Right to regular information about the sponsored child

- Right to communication with the organization

- Right to donation receipts for sponsorship contributions


5.3.2 Obligations

- Regular payment of sponsorship contributions

- Notification of changes to contact details

- Respectful treatment of the sponsored child and the organization


5.4 Communication with the Sponsored Child


5.4.1 Correspondence

- Sponsors can send personal messages to their sponsored children

- The organization facilitates communication

- The organization reserves the right to filter inappropriate content


5.4.2 Visits

- Visits to sponsored children are possible after prior consultation

- The organization coordinates visits and ensures they are in the best interest of the child


5.5 Termination of Sponsorships


5.5.1 Termination by Sponsor

- Sponsorships can be terminated at any time with one month's notice

- Termination must be made in writing (by email or mail)

- Already paid contributions will not be refunded


5.5.2 Termination by Organization

- The organization may terminate sponsorships if:

- The sponsored child is no longer in need

- The sponsorship cannot be continued for other reasons

- The sponsor fails to meet payment obligations

- The organization informs the sponsor in a timely manner about the termination


5.5.3 Transition Period

- After termination, the organization endeavors to find a new sponsor

- During the transition period, the sponsored child continues to be supported


6. Newsletter and Communication


6.1 Newsletter Subscription


6.1.1 Subscription

- Newsletters can be subscribed to via the website or as part of a donation

- Subscription occurs through user consent

- Consent can be revoked at any time


6.1.2 Content

- The newsletter contains information about:

- Projects and campaigns

- Success stories

- Reports on the use of donations

- New initiatives of the organization


6.1.3 Frequency

- The frequency of the newsletter is determined by the organization

- Users can adjust their preferences


6.2 Unsubscription


6.2.1 Revocation

- Consent to the newsletter can be revoked at any time

- Each newsletter contains an unsubscribe link

- Unsubscription can also be made by email or mail


6.2.2 Effectiveness

- Unsubscription becomes effective within 7 business days

- After unsubscription, no further newsletters will be sent


6.3 Other Communication


6.3.1 Email Notifications

- The organization sends email notifications regarding:

- Donation confirmations

- Payment confirmations

- Status updates on donations

- Important information about projects or sponsorships


6.3.2 WhatsApp Communication

- With consent, WhatsApp messages can also be sent

- Consent can be revoked at any time


7. Rights and Obligations of Donors


7.1 Rights of Donors


7.1.1 Right to Information

- Right to information about the use of donations

- Right to donation receipts

- Right to transparency reports and annual reports


7.1.2 Right of Revocation

- Right to revoke donations within legal deadlines (see Section 11)


7.1.3 Data Protection Rights

- Right to information about stored data

- Right to correction of incorrect data

- Right to deletion of data (as far as legally permissible)

- Right to data portability


7.2 Obligations of Donors


7.2.1 Truthful Information

- Obligation to provide truthful and complete information for all required data

- Obligation to notify changes to contact details


7.2.2 Payment Obligation

- Obligation to pay donation amounts on time

- Obligation to pay for recurring donations


7.2.3 Legal Compliance

- Obligation to comply with all applicable laws

- Prohibition of using the website for illegal purposes


8. Rights and Obligations of the Organization


8.1 Rights of the Organization


8.1.1 Acceptance or Rejection of Donations

- Right to accept or reject donations at own discretion

- Right to reject donations that violate ethical principles


8.1.2 Use of Donations

- Right to use donations according to the purpose of the organization

- Right to adjust projects in case of changed circumstances


8.1.3 Changes

- Right to change the website, projects, and services

- Right to change these GTC (with advance notice)


8.2 Obligations of the Organization


8.2.1 Use of Donations

- Obligation to use all donations for their intended purpose

- Obligation to transparency about the use of donations


8.2.2 Information Obligation

- Obligation to inform donors about the use of their donations

- Obligation to provide donation receipts


8.2.3 Data Protection

- Obligation to protect personal data of donors

- Obligation to comply with data protection regulations


9. Data Protection


9.1 Privacy Policy

- The processing of personal data is carried out in accordance with the separate privacy policy

- The privacy policy is available on the website and is part of these GTC


9.2 Data Processing


9.2.1 Collected Data

- The organization collects and processes personal data for processing donations, sponsorships, and other services

- The type of data collected is described in the privacy policy


9.2.2 Purpose of Processing

- Data is used exclusively for processing donations, sponsorships, and communication

- No sharing with third parties for commercial purposes


9.3 Data Security

- The organization takes technical and organizational measures to protect data

- Data is transmitted and stored encrypted


10. Liability


10.1 Limitation of Liability


10.1.1 General Limitation of Liability

- The organization is not liable for damages arising from the use of the website or the services offered, unless they are based on intent or gross negligence

- The organization is not liable for damages due to technical failures, outages, or interruptions of the website


10.1.2 Payment Service Providers

- The organization is not liable for errors, failures, or delays of payment service providers

- Liability is limited to the proper forwarding of payment requests


10.1.3 Projects and Campaigns

- The organization is not liable for changes, postponements, or discontinuations of projects or campaigns

- The organization endeavors to conduct projects as stated but cannot guarantee it


10.2 Limitation of Liability


10.2.1 Maximum Amount

- The organization's liability is limited to the amount of the respective donation

- Liability beyond this is excluded, as far as legally permissible


10.2.2 Indirect Damages

- The organization is not liable for indirect damages, consequential damages, or lost profits


10.3 Exceptions

- The limitations of liability do not apply in case of:

- Intent or gross negligence

- Violation of life, body, or health

- Violation of essential contractual obligations (cardinal obligations)


11. Revocation and Refund


11.1 Right of Revocation for Donations


11.1.1 Legal Right of Revocation

- Donations are generally not subject to a legal right of revocation, as they are gratuitous contributions

- Exceptions apply for certain cases under Swiss law


11.1.2 Voluntary Refund

- The organization may voluntarily refund donations if:

- The donation was made due to an error

- The donation cannot be used for the stated purpose

- Special circumstances justify a refund


11.1.3 Refund Request

- Refund requests must be made in writing (by email or mail)

- The request must contain the donation ID (UUID) and the reason for the refund

- The organization decides on refunds at its own discretion


11.2 Refund for Sponsorships


11.2.1 Already Paid Contributions

- Already paid sponsorship contributions are generally not refunded

- Exceptions may be made in special hardship cases


11.2.2 Termination

- Upon termination of a sponsorship, no future contributions will be collected

- Already paid contributions remain with the organization


11.3 Refund Procedure


11.3.1 Processing Time

- Refund requests are processed within 30 days

- The organization informs the applicant about the decision


11.3.2 Refund Method

- Refunds are made via the same method as the original payment

- Fees may apply for bank transfers, which are borne by the applicant


12. Donation Receipts


12.1 Issuance of Donation Receipts


12.1.1 Automatic Issuance

- Donation receipts are automatically issued for donations of 10 CHF or more

- Donation receipts are sent by email


12.1.2 Upon Request

- For donations under 10 CHF, donation receipts can be issued upon request

- The request must be made in writing (by email or mail)


12.2 Content of Donation Receipt

- Donation receipts contain:

- Name and address of the donor

- Donation amount

- Date of donation

- Donation ID (UUID)

- Purpose of donation (if designated)

- Tax-relevant information


12.3 Tax Recognition


12.3.1 Switzerland

- The organization is currently not yet recognized as a tax-exempt charitable organization

-Donation receipts are issued but cannot currently be used for tax purposes

-The organization endeavors to obtain tax recognition but cannot guarantee the timing or outcome


12.3.2 International

- Tax recognition in other countries depends on the respective national regulations

- The organization cannot guarantee tax recognition in other countries


12.4 Corrections

- Incorrect donation receipts can be corrected

- Corrections must be requested within 12 months of issuance


13. Intellectual Property


13.1 Copyright


13.1.1 Website Content

- All content of the website (texts, images, videos, logos) is protected by copyright

- Use of content is only permitted with express permission from the organization


13.1.2 Prohibited Use

- Reproduction, distribution, or commercial use of content is prohibited without permission

- Use for private, non-commercial purposes may be permitted


13.2 Trademark Rights

- The trademark "Swisslamic Help Organization" and all associated logos are protected

- Use of the trademark is only permitted with express permission


13.3 User Content

- Content submitted by users (e.g., comments, messages) may be used by the organization

- The organization reserves the right to delete or edit user content


14. Changes to the GTC


14.1 Right to Change

- The organization reserves the right to change these GTC at any time

- Changes are published on the website


14.2 Notification of Changes


14.2.1 Publication

- Significant changes are published on the website

- The current version of the GTC is always available on the website


14.2.2 Notification

- For significant changes, donors are informed by email

- Notification occurs at least 4 weeks before the changes take effect


14.3 Objection


14.3.1 Right to Object

- Donors can object to changes within 4 weeks after notification

- The objection must be made in writing (by email or mail)


14.3.2 Consequences of Objection

- In case of objection to changes, the contractual relationship ends at the next possible time

- Already made donations remain unaffected by the changes


14.4 Continuation

- If changes are not objected to, they are considered approved

- Continued use of the website or making donations is considered consent to the changed GTC


15. Final Provisions


15.1 Severability Clause

- Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected

- The legally permissible provision that comes closest to the economic purpose replaces the invalid provision


15.2 Written Form

- Changes or additions to these GTC require written form

- This also applies to the revocation of this written form clause


15.3 Partial Invalidity

- Should individual provisions of these GTC be wholly or partially invalid, this does not affect the validity of the remaining provisions


15.4 Statute of Limitations

- Claims against the organization are subject to statutory limitations

- The limitation period begins at the time the claim arose
